Jains, Sikhs part of broader Hindu religion, says SC

In a significant ruling defining the status of communities like Sikhs and Jains within the Constitutional frame work, the Supreme Court has declined to treat them as separate minority communities from the broad Hindu religion, saying encouraging such tendencies would pose serious jolt to secularism and democracy in the country.

“The so-called minority communities like Sikhs and Jains were not treated as national minorities at the time of framing of the Constitution. Sikhs and Jains, in fact, have throughout been treated as part of wider Hindu community, which has different sects, sub-sects, faiths, modes of worship and religious philosophies,” a Bench of Chief Justice R.C. Lahoti, Mr Justice D.M. Dharmadhikari and Mr Justice P.K. Balasubramanyan said.

Disposing of an appeal by Bal Patil and others against the Bombay High Court order, seeking direction to the Union Government to notify “Jains” as a minority community under Section 2 C of the National Commission for Minority Act, the Bench said: “We do not find that any case is made out for grant of any relief to appellants in exercise of writ jurisdiction of the High Court and hence, the writ jurisdiction of this (apex) court.”

The High Court had rejected their plea.

Quoting from the provisions of the Constitution and the historic background on how the Constitution had come into existence after Partition, the court said: “Encouragement of such fissiparous tendencies would be a serious jolt to the secular structure of the constitutional democracy.”

“We should guard against making our country akin to a theocratic state based on multi-nationalism. Our concept of secularism, to put it in a nutshell, is that the state will have no religion,” the Bench held, while asking the National Minorities Commission to “gear up its activities” to keep all religious groups in right direction with “constitutional perspective, principles and ideals in its view”.

Mr Justice Dharmadhikari, writing the judgement for the Bench, said the Constitution had clearly laid down that “the state will treat all religions and religious groups equally and with equal respect without in any manner interfering with their individual rights or religions, faith and worship.”

The court said in various codified customary laws like the Hindu Marriage Act, the Hindu Succession Act, the Hindu Adoption and Maintenance Act and other laws of pre and post-Constitution period, definition of “Hindu” included all sects, sub-sects of Hindu religion, including Sikhs and Jains.

It said if the argument for recognising every religious group within the broad Hindu religion as separate religious minority was accepted and such tendencies were encouraged, “the whole country, which is already under class and social conflicts due to various divisive forces, will further face divisions on the basis of religious diversities”.

“Such claims to minority status based on religion would increase in the fond hope of various sections of people getting special protections, privileges and treatment as part of constitutional guarantee,” the court said adding “a claim by one group of citizens would lead to a similar claim by another group and conflict and strife would ensue”.

The court further clarified that the framers of the Constitution had “engrafted” a group of Articles (25 to 30) in the Constitution recognising only Muslims, Christians, Anglo-Indians and Parsis as religious minorities at national level by taking into consideration the historic background on how these communities had emerged over a long period of time during the Mughal and British rule.

The court also said the Union Government, in its affidavit, had taken the stand that in accordance with the law laid down by the majority judgement in TMA Pai case by the apex court regarding the statues of minority educational institutions in the country, it had been left to state governments to decide as to where Jain community should be treated as minority.

The court also noted that in states like Chhattisgarh, Maharashtra and Uttranchal, Jains had already been notified as minority in accordance with the provisions of the respective State Minority Commission Acts.

raju, i don't have anything against loving India, but this surajsingh character always makes it seem like we are slaves in teh westa nd refuses to see it that way in india. gotta be both ways, not one sided.

Guru Gobind Singh Ji suffered more than Sikhs suffered in recent time. He taught Sikhs to be in Chardi Kalah and fight against injustice. He didn't fly from India to live in the west. He didn’t do yearly demonstration in front of Indian embassy or wrote anti-India remarks on message boards. If you read his Zaffarnama, he is respectful although he knew he was writing it to Auranzeb. People who got guts fight for their rights and don't rant online.

Dr. Bhimrav Ambedkar has significant role in putting Sikhs under Hinduism umbrella. Sikhs protested it but he didn’t take it seriously. People like you should learn from blacks of America. They are leading in all kind of ventures with their hard work. They are minority and suffered a lot during slavery but still they didn't leave this country to protest. People who get results always stand for their rights not in front of Indian embassy every year so learn from Sikhs in Jaipur, Rajasthan. Bring some results for the Sikhs if you are really committed and move back to India or stop this politics.

Whats wrong with India. I get mad respect anywere I go in india. Amritsar is probably the best place to live. Close to Darbaar sahib. Thats the best place in terms of sikhi. Enough kids in the west been brainwashed by the hole Anti India thing, its still an ill place to live if your a sikh. The fact that you can walk around in sikhi saroop and be able to go to Darbaar Sahib everyday makes it 10000x better than any place in the world. Your living in the same place as your GURU'S. If you talkin about your careers n stuff, move to Canada/UK/U.S/Australia etc.

the land our guru stepped on is great...amritsar is heaven! we're so lucky to have it....the greatest gursikhs are from India...so what sux about it? the oppression we face...so the answer? khalistan all the way....

we are respected by those who are true sikhs themselves, but what about the singhs whose mouths have been stuffed by cigarettes by the inidan police? what about the deaths that havent been justified? what about the families that have been traumatized by the police? what about the sikhs who were hung by their armsbehind their back while weights were put on their feet so that their arms would come out of their sockets? what about the sikhs burned and boiled alive?what about the sikhs who had to endure a huge log being rolled on their legs, crushing their bones? india is great because a lot of our history is preserved there, but the harassment we face and the lengths we have to go to in order to keep it preserved can never be forgotten...

Indian govt is supposed to interfere in all manner of schoolfights now ?? Well...

Oh they don't ohmy.gif .. Well in states they do with great interest.. even they had their department guy come around the school during starting/ending time.

Jithay veey rahenday yo.. kush rahoo and thats the best place for your soul. Don't think that particular boundary of some country is best place for sikhs.. sikhs shouldn't be on the quest to find the area where they can live happy but they should make the area, wehre they are lving a happy peace loving place.

    • How is it going to help? The link is of a Sikh hunter. Fine, but what good does that do the lazy Sikh who ate khulla maas in a restaurant? By the way, for the OP, yes, it's against rehit to eat khulla maas.
    • Yeah, Sikhs should do bhog of food they eat. But the point of bhog is to only do bhog of food which is fit to be presented to Maharaj. It's not maryada to do bhog of khulla maas and pretend it's OK to eat. It's not. Come on, bro, you should know better than to bring this Sakhi into it. Is this Sikh in the restaurant accompanied by Guru Gobind Singh ji? Is he fighting a dharam yudh? Or is he merely filling his belly with the nearest restaurant?  Please don't make a mockery of our puratan Singhs' sacrifices by comparing them to lazy Sikhs who eat khulla maas.
    • Seriously?? The Dhadi is trying to be cute. For those who didn't get it, he said: "Some say Maharaj killed bakras (goats). Some say he cut the heads of the Panj Piyaras. The truth is that they weren't goats. It was she-goats (ਬਕਰੀਆਂ). He jhatka'd she-goats. Not he-goats." Wow. This is possibly the stupidest thing I've ever heard in relation to Sikhi.
    • Instead of a 9 inch or larger kirpan, take a smaller kirpan and put it (without gatra) inside your smaller turban and tie the turban tightly. This keeps a kirpan on your person without interfering with the massage or alarming the masseuse. I'm not talking about a trinket but rather an actual small kirpan that fits in a sheath (you'll have to search to find one). As for ahem, "problems", you could get a male masseuse. I don't know where you are, but in most places there are professional masseuses who actually know what they are doing and can really relieve your muscle pains.
    • Good way of putting it, bro. One of the ongoing themes of Gurbani is the fake saint. Whether it's fake babas in Punjab or English-speaking personalities in the West, it's an continuing problem of religion through the centuries (and it's not exclusive to us by any means, this applies to all human societies).
