NEW DELHI: The Supreme Court on Friday refused to entertain Congress leader JagdishTytler's plea seeking a stay on a trial court order directing CBI to conduct further probe into his alleged role in a 1984 anti-Sikh riots case. A bench headed by Justice P Sathasivam said that the apex court should not interfere in the matter at this stage as the case is pending in the Delhi high court which is scheduled to hear it on September 18. Sensing the mood of the bench, senior advocate Mukul Rohatgi agreed to withdraw the petition which was allowed by the court. Tytler approached the apex court challenging the high court's July 3 order refusing to grant interim stay on the trial court's order. The high court had refused to stay the probe saying, "Only investigation is ordered and this court will not stop the investigation." Tytler had on May 30 moved the high court challenging the trial court order setting aside the CBI's closure report giving him a clean chit in the 29-year-old case and directing the probe agency to examine eye-witnesses and people claiming to have information about the riots. Tytler, in his plea before the high court, had said that the trial court order is contrary to the scheme of code of CrPC. The method and mode of investigation by a probe agency is the absolute prerogative of the agency and it is not for the court to direct the agency that which witness should be examined by it, he had said.   5. New Delhi, India (June 05, 2013): Sikh Siyasat News has accessed a US Diplomatic cable published by Public Library of US Diplomacy (PLUS D), commonly known as Wikileaks. This cable contains a number of political highlights from Embassy New Delhi for Decemebr 17-21, 2007, including information and comment about the court order reopening November 1984 case against Jagdish Tytler. The concerned/relevant portion of the above mentioned US cable is as follows: Court Orders Reopening Riots Case Against Congress Leader Date:2007 December 20, 12:39 (Thursday) 1. (U) Justice may yet be served in the case of former Congress Minister Jagdish Tytlers orchestrating role in Delhis 1984 anti-Sikh riots. A Delhi court has ordered Indias Criminal Bureau of Investigations (CBI) to reopen the case against Tytler to take into account statements from a key witness. Jasbir Singh, now settled in the U.S., claimed to have overheard and seen Tytler inciting and leading murderous mobs in North Delhi during the riots. The Nanavati Commissions original investigation into Tytlers role during the riots found credible evidence that he played a role in organizing the communal attacks, but the CBI controversially recommended closure of the case in September for lack of evidence and because Jasbir Singh supposedly could not be traced. Singh filed his affidavit in 2000 but subsequently moved to the U.S. where Indian authorities insisted they had been unable to reach him until he recently resurfaced through media outlets following the closure of the case. 2. © Comment: Tytlers day in court is long overdue. In the days after Indira Gandhis assassination, he was among the local Congress Party leaders competing with one another to see which wards would shed more Sikh blood. In exhorting his party cadres and goons to kill more Sikhs, he is reported to have told them they shamed him in the eyes of the top Congress leaders because there were fewer killings in his wards. The killing by his henchmen apparently ensured his success in establishing Congress Party bona fides and demonstrating fealty to the Nehru-Gandhi dynasty because he has regularly been given the Congress Party ticket in parliamentary elections since then and has served as a federal Minister in Congress-led governments. The role of Tytler and other Congress leaders continues to be a millstone for the Congress Party and the secular credentials it professes to espouse. Many commentators view the Congress Partys involvement in inciting and murdering innocent civilians in 1984 as far worse than the purported role of Gujarat Chief Minister Modi in condoning the 2002 Gujarat riots. While these recent court developments do not imply that we will see Tytlers conviction none of the mob leaders have been convicted in the 23 years since the riots they are a step towards justice for the families victim to Tytlers murderous actions in 1984. The courts order shows how the CBI has become a pliant pawn of political masters but also demostrates the fierce independence of the Indian judiciary. Note: Despite his notoriety, we learned recently that Tytler has a valid B1/B2 visa. End Note. Ghosts of anti-Sikh riots return to haunt Jagdish Tytler, Sajjan Kumar PTI | Feb 19, 2013, 19:35PM IST New Delhi: A Delhi court took strong exception to CBI's failure to advance final arguments today in a 1984 anti-Sikh riots case against Congress leader Jagdish Tytler as victims staged a protest outside against the alleged delay in handing out justice. The riots victims gathered outside the Karkardooma Court complex here and shouted slogans demanding justice for them and their family members who were killed in the riots. They were raising slogans seeking strict punishment for Tytler and Congress leader Sajjan Kumar, who is facing trial for his alleged role in instigating the mob to kill Sikhs after the assassination of the then Prime Minister Indira Gandhi on October 31, 1984. During the hearing, the court directed CBI prosecutor, who sought more time for advancing his arguments as he was not prepared today, to begin his arguments on the next date of hearing on March 20, failing which the judge said she would pass the order in the case on the basis of available evidence. "If the arguments are not advanced by CBI on March 20, the next date of hearing, the order will be passed on the basis of material available on record," Additional Sessions Judge Anuradha Shukla Bhardwaj said. The court was hearing final arguments on the protest petition filed by riot victim Lakhwinder Kaur, whose husband Badal Singh was killed in the riots, challenging the CBI's closure report and clean chit to Tytler in the case. The case was fixed for today for CBI's arguments as on the last date of hearing the prosecutor was not available while senior advocate H S Phoolka and advocate Kamna Vohra, appearing for the victims, had concluded their arguments. CBI prosecutor Sanjay Kumar said he has been handed over the charge of the case file recently so was not fully prepared to argue. The judge asked the prosecutor what was the problem and why he cannot argue when the CBI officials were told earlier also that the case has been fixed for their submissions. "Give me one final date when you can argue.
