He is now at risk of imminent execution. The mercy petitions of two other men were also rejected by the President in August, and reports suggest they could be executed on 22 August. Devender Pal Singh Bhullar was sentenced to death in August 2001 for his involvement in a bomb attack in New Delhi in 1993 that killed nine people. He was arrested under the Terrorist and Disruptive Activities (Prevention) Act (TADA), a law that contained provisions incompatible with international fair trial standards, and had no access to a lawyer during his initial detention and trial. He was found guilty on the basis of a confession to the police which he later retracted, claiming it was made under police pressure. In March 2002, the Supreme Court upheld his death sentence, though one of the three judges had found him not guilty, saying there was no evidence to convict him. The President rejected Devender Pal Singh Bhullar's mercy petition in May 2011, eight years after the request was filed. This decision was challenged before the Supreme Court, including on grounds of an inordinate delay in the consideration of his mercy petition. The Supreme Court rejected his plea on 12 April, in a judgement that ignored claims he had been subjected to cruel, inhuman or degrading treatment or punishment. A review petition of this judgment was dismissed on 14 August 2013. Devender Pal Singh Bhullar has been receiving treatment at a psychiatric facility, and a medical board has reportedly stated that he is suffering from severe depression and shows symptoms of psychosis and suicidal tendencies. International standards on the use of the death penalty prohibit the use of capital punishment against people with mental disability. Since taking office, President Pranab Mukherjee has rejected mercy petitions of at least 19 people. In August, he rejected the mercy petitions of Shivu and Jadeswamy, who were sentenced to death in July 2005 for the rape and murder of a woman in 2001. Their executions have been reportedly scheduled for 22 August. On 21 August, the Supreme Court will hear petitions from Shivu and Jadeswamy seeking commutation of their sentences. In the past, some mercy petition decisions have been challenged before the higher judiciary on grounds of undue delay by the executive in the consideration of such petitions. However, the decision to hear such a challenge is left to the discretion of the higher judiciary. In April 2012, the Supreme Court, while upholding Devender Pal Singh Bhullars death sentence, stated that delay cannot be invoked in cases where a person is convicted for an offence under TADA or similar statutes. The court decided not to commute the death sentence based on the enormity of the crime. Since assuming office in 2012, President Pranab Mukherjee has rejected mercy petitions of at least 19 people - Ajmal Kasab, Saibanna, Afzal Guru, Gnanprakasham, Simon, Meesekar Madaiah, Bilavendran, Suresh, Ramji, Gurmeet Singh, Sonia Choudhary, Sanjeev Choudhary, Jafar Ali, Dharam Pal, Praveen Kumar, B A Umesh, Maganlal Barela, Shivu and Jadeswamy . India has executed two of these individuals: Ajmal Kasab on 21 November 2012 and Afzal Guru on 9 February 2013. These two executions were considered out of turn and were not announced to the public until they had been carried out. A government minister stated that no prior announcement was made in Ajmal Kasabs case to avoid intervention from human rights activists. In Afzal Gurus case, the family only received notification of the execution after it had been carried out, and the body was not returned to them for burial. Prior to these, the last execution in India had been that of Dhananjoy Chatterjee in August 2004. Of the remaining cases, Santhan, Murugan, Perarivalan, Gnanaprakasam, Simon, Madaiah and Bilavendran were originally convicted by a TADA court. On 22 October, the Supreme Court will begin hearing the cases of at least 17 individuals who are seeking commutation of their death sentences after presidential rejection of their mercy plea. Indian authorities used to make information about the rejection of mercy petitions and dates of execution available to the public before any executions. However they have stopped this practice since 2012, making it difficult to know which mercy petitions are being considered, when decisions are be made, and whether these decisions would be public. In resolution 2005/59 the UN Commission on Human Rights called upon all states that still maintain the death penalty to make available to the public information with regard to the imposition of the death penalty and to any scheduled execution. Indias resumption of executions has set the country against regional and global trends towards abolition of the death penalty As of today, 140 countries are abolitionist in law or in practice. Out of 41 countries in the Asia-Pacific region, 17 have abolished the death penalty for all crimes, 10 are abolitionist in practice and one Fiji uses the death penalty only for exceptional military crimes. Over the past 10 years, four Asia-Pacific countries abolished the death penalty for all crimes: Bhutan and Samoa in 2004, the Philippines in 2006 and the Cook Islands in 2007. UN bodies and mechanisms have repeatedly called upon member states to establish a moratorium on executions with a view to abolishing the death penalty, including through the adoption of four UN General Assembly resolutions in December 2007, 2008, 2010 and 2012. Tarlochan Singh urges PM to help Sikh farmers in state Tarlochan Singh, former chairman of the National Commission for Minorities, on Friday sought Prime Minister Manmohan Singh's help in ensuring that Sikh farmers in Haryana were not "ousted" by the state government, following the end of their 50-year lease for tilling. In a letter to the Prime Minister, he urged him to step in and convince the state government against ousting them. "We are thankful to you for showing concern for the Sikh farmers in Gujarat, who, after 50 years of farming, have been ousted," Tarlochan wrote. "The plight of Sikh farmers in Haryana is much more serious and painful. You remember sir, when you visited Pehowa during an election tour, this particular case of the Sikh farmers in that area was brought to your notice and you, very graciously, announced that they will not be ousted and the Haryana chief minister will take necessary action to protect their rights," he wrote. Tarlochan said 3,500 Sikh families in Kurukshetra and Kaithal districts, who were occupying and tilling the land for the past 55 years, have been ousted forcibly. "As you are aware, on the advice of the central government, Sikh farmers were given barren lands on lease for making them fully fertile in Uttar Pradesh, Andaman and Nicobar, Haryana and Gujarat," he explained. "After the expiry of lease in Haryana, the Sikh farmers were forcibly told to quit. For years, they were fighting in court, and ultimately the Supreme Court decided that legally they can't be owner of that land, but the Haryana government shall make provisions to allow them to cultivate the lands," said Tarlochan, who is also a senior sports administrator. "I may bring to your notice that only last month at Krah Sahib village, Sikhs were made landless with the help of police. Some villages where the Sikhs are still occupying the land, the authorities have cut the power supply to harass them," he said. He said: "But, these poor farmers are denied protection under the existing law that says that any farmer who has been occupying the land for 15 years cannot be ousted. But, these farmers, who were there for 50 years, are not being given any help." They said, "If India executes Bhullar it will signal to the world that it is backward and prepared to eliminate all Sikh prisoners." Swire told the delegation that UK was against the death penalty in all circumstances. Swire said UK will monitor the case of Bhullar closely "as we will in all cases where the death penalty has been given as a sentence". He further said that UK will call on the Indian government to reintroduce a moratorium on the death penalty, with a view to formal abolition. "We are against death penalty and we aren't changing that," Swire had told TOI recently.

  9. New Delhi Municipal Corporation has raised an objection on 1984 Sikh Genocide Memorial inside Rakab Ganj Gurdwara. The corporation pasted a notice on Gurdwara complex gate opposite parliament house objecting over 4 feet high brick platform constructed to be unveiled on June 12 as foundation stone of the memorial.   10. The foundation stone of 1984 Sikh Genocide Memorial being built in Gurdwara Rakabanj Sahib Complex was unveiled on Wednesday. Hearing in a petition challenging construction of memorial in the Gurdwara premises was also listed for hearing in Delhi high court but the foundation stone was laid before the case came for hearing. Before the foundation stone was to be laid, there was obvious tension at the site where foundation stone was to be laid. A large number of Sikhs carrying swords were guarding the site and movement of every person was closed watched. It needs mention here that former president of DSGMC Paramjit Singh Sarna has moved Delhi high court against building of memorial in the Gurdwara premises. Foundation stone was unveiled by head priests of Sikhs - Jathedar of Takht Shri Damdama Sahib Giani Balwant Singh Nandgarh, Jathedar of Akal Takht Giani Gurbachan Singh and Jathedar of Takht Shri Keshgarh Sahib Giani Tarlochan Singh. Shiromani Akali Dal-Badal president and deputy chief minister Punjab Sukhbir Singh Badal, his MP wife Harsimrat Kaur, DSGMC president Manjit Singh GK and Shiromani gurdwara parbandhak committee (SGPC) Avtar Singh Makkar were also present. The foundation stone laying ceremony coincided with martyrdom day of fifth Guru Arjan Dev. A large number of Sikhs gathered at the site where foundation stone was laid. Before the elections of Delhi Sikh Gurdwara management committee (DSGMC) in January earlier this year, building of a memorial to commemorate those Sikhs killed in 1984 riots, was part of election manifesto of Shiromani Akali Dal-Badal in the elections. "We have fulfilled our promise," said Shiromani Akali Dal-Badal president Sukhbir Singh Badal after unveiling ceremony. Later addressing the media-persons, Sukhbir Badal said that justice was denied to the families of innocent Sikhs killed in 1984 riots for past 29 years and now the congress party led government in Delhi was making attempts to stall construction of the memorial. "Wasn't killing of innocent Sikhs illegal," he said on being asked by media that New Delhi municipal corporation (NDMC) has served notice to DSGMC, calling construction of the foundation stone for the memorial as illegal. NDMC served notice to NDMC last week. BJP national president Rajnath Singh, leader of opposition in Lok Sabha Sushma Swaraj, Rajya Sabha MP Naresh Gujaral, BJP's Delhi unit president Vijay Goyal, former chairman of minorities commission Tarlochan Singh, and DSGMC general secretary Manjinder Singh Sirsa were also present on the occasion. Speaking on the occasion DSGMC president Manjit Singh GK said that memorial would remind the generations about the unjustice done to the Sikh community. Speaking about construction of the memorial, GK adds that no illegality was done and DSGMC would take all permissions from NDMC before starting construction of memorial. This cable contains a number of political highlights from Embassy New Delhi for Decemebr 17-21, 2007, including information and comment about the court order reopening November 1984 case against Jagdish Tytler. The concerned/relevant portion of the above mentioned US cable is as follows: Court Orders Reopening Riots Case Against Congress Leader Date:2007 December 20, 12:39 (Thursday) 1. (U) Justice may yet be served in the case of former Congress Minister Jagdish Tytlers orchestrating role in Delhis 1984 anti-Sikh riots. A Delhi court has ordered Indias Criminal Bureau of Investigations (CBI) to reopen the case against Tytler to take into account statements from a key witness. Jasbir Singh, now settled in the U.S., claimed to have overheard and seen Tytler inciting and leading murderous mobs in North Delhi during the riots. The Nanavati Commissions original investigation into Tytlers role during the riots found credible evidence that he played a role in organizing the communal attacks, but the CBI controversially recommended closure of the case in September for lack of evidence and because Jasbir Singh supposedly could not be traced. Singh filed his affidavit in 2000 but subsequently moved to the U.S. where Indian authorities insisted they had been unable to reach him until he recently resurfaced through media outlets following the closure of the case. 2. © Comment: Tytlers day in court is long overdue. In the days after Indira Gandhis assassination, he was among the local Congress Party leaders competing with one another to see which wards would shed more Sikh blood. In exhorting his party cadres and goons to kill more Sikhs, he is reported to have told them they shamed him in the eyes of the top Congress leaders because there were fewer killings in his wards. The killing by his henchmen apparently ensured his success in establishing Congress Party bona fides and demonstrating fealty to the Nehru-Gandhi dynasty because he has regularly been given the Congress Party ticket in parliamentary elections since then and has served as a federal Minister in Congress-led governments. The role of Tytler and other Congress leaders continues to be a millstone for the Congress Party and the secular credentials it professes to espouse. Many commentators view the Congress Partys involvement in inciting and murdering innocent civilians in 1984 as far worse than the purported role of Gujarat Chief Minister Modi in condoning the 2002 Gujarat riots. While these recent court developments do not imply that we will see Tytlers conviction none of the mob leaders have been convicted in the 23 years since the riots they are a step towards justice for the families victim to Tytlers murderous actions in 1984. The courts order shows how the CBI has become a pliant pawn of political masters but also demostrates the fierce independence of the Indian judiciary.   14. Congress leader Jagdish Tytler Thursday moved the Delhi High Court against the trial court order of reopening a case against him related to the 1984 anti-Sikh riots. On April 10, the trial court ordered the reopening of case against Tytler and also set aside the Central Bureau of Investigation's (CBI) closure report, which gave him a clean chit saying there was "no evidence" against him. Tytler, filing an appeal in the court, said: "The trial court order is contrary to the Criminal Procedure Code. The method and mode of investigation by a probe agency is the absolute prerogative of the agency. It is not for the court to direct the agency about which witness should be examined by it." Seeking that the trial court order be quashed in the 29-year-old case, the plea said: "The settled position of law is that a direction for investigation can be given only if an offence is prima facie found to have been committed or a person's involvement is prime facie established. But direction to investigate whether any person has committed an offence or not cannot be legally given." The appeal is likely to be listed for hearing on Friday. The trial court's order of May 10 came on a plea filed by a riot victim, who sought further probe into the killing of three people near Gurdwara Pul Bangash in old Delhi. Tytler is accused of instigating a mob that led to the murder of three men who had taken shelter at the gurdwara Nov 1, 1984. The mob attack was part of violence against Sikhs after the assassination of then prime minister Indira Gandhi Oct 31 that year. The trial court had also directed the CBI to examine witnesses and people who claimed they have information about the riots. The court, setting aside the magisterial court order that accepted the CBI's closure report, had said: "The order of the trial court accepting the closure report is set aside. The CBI is directed to conduct further investigation in the light of aforesaid facts and to record the statements of witnesses, who, it had come to know during the investigation itself, are claiming/shown/named to be witnesses of the incident." The CBI had an "obligation" to record the statement of three US-based men, whose names were taken by a witness, who said they were also present at the spot, the court had observed in the order. Opposing the victim's plea, the probe agency had sought its dismissal, saying its probe made it clear that Tytler was not present at Gurudwara Pul Bangash on Nov 1, 1984, during the riots. However, senior advocate H.S. Phoolka, appearing for petitioner Lakhwinder Kaur, had said that there was material which the CBI had ignored. Three men - Badal Singh, Thakur Singh and Gurcharan Singh - were killed near Gurudwara Pul Bangash, allegedly on Tytler's instigation. Tytler's role in the killing of three men was re-investigated by the CBI after a court in December 2007 refused to accept the closure report. The CBI claimed that Tytler was at Teen Murti House, the residence of the late prime minister Jawaharlal Nehru, where Indira Gandhi's body was kept, at the time of the Pul Bangash incident. It added that the agency has already re-investigated the case on the order of a trial court, but there was insufficient evidence against Tytler. PTI | May 9, 2013, 07.51 PM IST NEW DELHI: Three people were on awarded life imprisonment in a 29-year-old 1984 anti-Sikh riots case by a Delhi court which said the offences were grave as the victims of a particular community had been targeted and the acts of the convicts were most gruesome in nature. District judge JR Aryan gave life term to ex-councillor Balwan Khokkar, Girdhari Lal and retired naval officer Captain Bhagmal for murder and rioting in the case in which senior Congress leader Sajjan Kumar was acquitted on April 30, which CBI had reportedly said would challenge in the Delhi high court. The court rejected CBI's plea for death sentence to Balwan, Lal and Bhagmal, saying their offence does not come under the category of rarest of rare warranting capital punishment. "They had no special or personal animosity towards anyone or the deceased individually. The assassination of Prime Minister Indira Gandhi had blindfolded those youths and unfortunately, there was no leadership to bridle the mob frenzy unleashed with all cruelty," it said. Two other convicts, ex-MLA Mahinder Yadav and Kishan Khokkar were awarded three-year imprisonment and the court rejected their plea to release them on probation. Kumar was acquitted by the court which held that he deserved "benefit of doubt" since one of the victims and key witness Jagdish Kaur did not name him as an accused in her statement recorded by the Justice Ranganath Mishra panel in 1985. The case, in which the five people were held guilty pertains to killing of five Sikhs — Kehar Singh, Gurpreet Singh, Raghuvender Singh, Narender Pal Singh and Kuldeep Singh — by the mob in Raj Nagar area in Delhi Cantonment. The victims were members of the same family. In his ten-page order on sentence, the court said "... There cannot be two opinions that offences committed in this case were grave where victims of a particular community had been targeted for killing and destroying their properties. This court has already taken the facts into consideration that there were 341 killings in the area of police station Delhi Cantonment of this case itself."

Nirpreet Kaur, a 1984 riots victim, ended her fast after she was informed by Punjab Chief Minister Parkash Singh Badal and Deputy CM Sukhbir Singh Badal that President Pranab Mukherjee had assured a delegation of political parties that he would look into the demands of the riot victims. Nirpreet Kaur had been on a fast at Jantar Mantar since the past six days to protest against the acquittal of Congress leader Sajjan Kumar by a District Sessions Court in a 1984 riots case. Badal and Sukhbir went to Jantar Mantar to meet Nirpreet Kaur after meeting the President, Prime Minister Manmohan Singh and Union Home Minister Sushil Kumar Shinde. Addressing a gathering, they said representatives of all political parties, except the Congress, had accompanied them to meet the President on the issue. Badal asked the DSGMC and the SGPC to approach the Supreme Court, seeking that the Centre be directed to form a special investigating team (SIT) to look into the 1984 riots. The delegation was led by Parkash Singh Badal. The latter briefed the President about the details of the case and the “injustice” done to the Sikh community. The delegation sought the President’s intervention in directing the Central Government to order a Supreme Court-monitored special investigating team (SIT) to probe the attack on Sikhs after the assassination of Indira Gandhi. It pleaded that the investigation should be completed within a given time. The delegation said that the CBI should challenge the verdict on Sajjan Kumar’s acquittal in the High Court and file a charge sheet in another case registered with the Nangloi police station. It said that investigations against Congress leader Jagdish Tytler be expedited. Leaders of the BJP and the SAD along with those of the Shiv Sena, Samajwadi Party, TDP, JMM, INLD, BJD and the JD-U handed over a memorandum to the President.

The CBI will challenge before Delhi High Court the acquittal of Congress leader Sajjan Kumar in a 1984 anti-Sikh riots case by a city court as it has found "strong grounds" which could form basis of its petition. CBI sources said here today that the agency is likely to wait till the court pronounces its verdict on the quantum of sentence for those found guilty in the case. District and Sessions Judge JR Aryan had on April 30 acquitted Kumar in the 29-year-old case in which he was accused of murder and of instigating a riotous mob that killed five Sikhs in Delhi's cantonment area. Five others — Balwan Khokkar, an ex-councillor, Mahender Yadav, an ex-MLA, Kishan Khokkar, Girdhari Lal and Captain Bhagmal — were convicted for their involvement in the riots that had broken out after the assassination of the then Prime Minister Indira Gandhi on October 31, 1984. Kumar, a former Lok Sabha MP from Outer Delhi who was refused a Congress ticket for the 2009 Lok Sabha elections, still faces a trial in another 1984 rioting case. In a third case, the Delhi Police have filed a closure report, saying there was no evidence against Kumar to implicate him. His acquittal has led to protests by Sikh outfits in the national capital and in parts of Punjab. I was reading an article somewhere some months ago I dont know where it is now but there the journalist had suggested a letter was sent to indira gandhi to sant bhindranwale and the indian army and raw agents went into the sikh reference library to find it. They found alot of documents such as khalistani stamps, passports, documents and historical letters, etc but they found not find that important letter that indira had wanted found. Maybe this is why in frustration they burned the library down. I was wondering what was contained in that letter if anyone knows? And why was Indira so specific t to be found.

Reportedly paid to mob Rs. 100 each plus a bottle of liquor. A white ambassador car reportedly belonging to him came 4 times to the G.T. Road area near Azadpur. Instructions to mobs indulging in arson were given from inside the car. 5. Dharam Das Shastri, Cong. (I) M. P. from Karol Bagh. Reported to becarrying voters list with him at Prakash Nagar for identification of Sikhs. On November 5, according to newspaper reports, he along with other Congress-I leaders tried to pressurize the SHO of Karol Bagh Police Station to release the persons who arrested during the police raids to recover looted property. 6. Jagdish Tytler, Cong.(I) M. P. from Sadar Constitutency. On 6th November 5 p.m. he barged into a press conference that the Police Commissioner S. C. Tandon was holding. A journalist reports that he told the Police Commissioner that "by holding my men you are hampering the relief work". 7. Mahendra, Metropolitan Councillor. Reported to have accompanied Dharam Das Shastri with voters lists at Prakash Nagar. 8. Mangat Ram Singal, Member of Municipal Corporation (Ward No. 32) was reportedly with Dharam Das Shastri and Mahendra at Prakash Nagar. 9. Dr. Ashok Kumar, Member of Municipal Corporation, Kalyanpuri. Reportedly held a meeting in Kalyanpuri, following which violence broke out immediately. According to many eye witnesses he led mobs which indulged in loot, murder, arson and rape. 10. Sukhan Lal Sood, Metropolitan Councillor. According to eye witnesses was seen leading mobs, which indulged in loot, murder, arson and rape. He had come with petrol and serial lists and addressess of Sikhs in the locality. The women refugees, recognized him and drove him out. 11. Jagdish Chander Tokas, Member of Municipal Corporation Munirka (Ward No. 14) reportedly led a mob to R.K. Puram Sector IV and V. 12. Ishwar Singh, Member, Municipal Corporation, Mangolpuri (Ward No. 37). Allegedly led the mobs that indulged in looting, burning, rape and murder in Mangolpuri area. 13. Balwant Khokhar, Youth Congress-I Leader, Delhi, Identified as one of the persons responsible for instigating looting and arson in Palam Colony area. 14. Faiz Mohammad, Youth Congress-I Leader, Delhi, named by refugees in Shakurpur camp and in Mangolpuri for being a part of the mob indulging in looting, arson and murder. 15. Ratan, Youth Congress-I Leader, Delhi, named as having taken part in violence and looting in Palam Colony area. 16. Satbir Singh, Youth Congress-I. He allegedly brought bus loads of people from Ber Sarai to Sri Guru Harkrishan Public School (Munirka). They burnt school buses and parts of the school building. He was reportedly involved in looting and beating of Sikhs which carried on throughout the night on November 1. II. Mob was accompanied by Malhotra, who moved with one jeep, station-wagon, two men with sten-guns and revolvers, petrol-cans and stones. He supplied weapons to the mob, according to eve-witness accounts. Reportedly incited mobs at Laxmi Nagar, Gurunangal Nagar (under Shahdara P. S. ) 2. Jai Singh, S.H.O., Allegedly told mobs in troubled area that they could do what they wanted for three days. 3. Rao Ram Mehar, S.H.O. at Shakarpur reportedly pointed out Shik shops and houses to the mob. 4. Hari Ram Bhatti, S.H.O. Sultanpuri P. S. reported to have helped the mob by disarming the Sikhs. On November 1 and 2 it is alleged that he himself killed them. On 3 and 4 reported to have had the Sikhs shaven at gun point. 5. Ravtas Singh, S.H.O. Sadar Thana.
